1. PURPOSE AND ACCEPTANCE

1.1. These Terms of Service (hereinafter "TOS") govern the access to and use of the marketplace BloxBay.gg (hereinafter "the Site"), which offers a service for the exchange of hand-drawn digital artworks ("Artworks") that can be exchanged for in-game skins intended for Murder Mystery 2 (MM2).

1.2. By accessing and using the Site, you agree unconditionally to all the provisions of these TOS. If you do not agree with any of these provisions, you must immediately cease using the Site.

2. DESCRIPTION OF THE SERVICE

2.1. The Site provides a platform that allows Users to list and purchase digital artworks ("Artworks") representing skins intended for MM2.

2.2. The Site acts solely as an intermediary facilitating the connection and execution of exchanges between Users. Once the transaction is completed and payment is confirmed, the exchange is carried out in accordance with the instructions agreed upon by the parties. The Site is limited to providing the tools and interface for completing such exchanges and does not intervene in the technical execution or verification of the transaction.

2.3. By using the Site, Users acknowledge and agree that all exchange operations are undertaken at their own risk and that the Site does not guarantee, in any way, the compliance, validity, or quality of the exchange executed.

3. INTELLECTUAL PROPERTY

3.1. The Artworks offered on the Site remain the exclusive property of their creators, unless expressly stated otherwise.

3.2. Users agree not to reproduce, distribute, modify, or resell the Artworks without the prior consent of the rights holders.

3.3. The Site disclaims all liability for any intellectual property rights violations committed by Users during their transactions.

4. TRANSACTIONS AND USER RESPONSIBILITIES

4.1. All transactions concluded on the Site are made directly between Users, who bear full responsibility for the outcomes.

4.2. The Site does not guarantee the quality, authenticity, or legality of the Artworks offered, which are sold "as is."

4.3. Users are solely responsible for verifying the compliance and validity of the Artworks before making any purchase.

4.4. In the event of any dispute between Users, it is mandatory to first contact our customer service at smtpbloxbay@gmail.com in order to seek an amicable resolution. No dispute may be brought before a court until this procedure has been undertaken.

5. LIMITATION OF LIABILITY

5.1. The Site is provided "as is" and "as available."

5.2. BloxBay.gg shall not be held liable for any direct, indirect, special, or consequential damages (including, but not limited to, loss of profits, loss of data, or any other commercial loss) resulting from the use or inability to use the Site.

5.3. The Site disclaims all liability for any errors, omissions, or technical malfunctions in facilitating the exchanges.

5.4. The Site shall not be held responsible if a User's account is hacked or compromised due to the User’s negligence in managing their login credentials. Each User is responsible for maintaining the confidentiality of their login information.

5.5. In the event of force majeure or circumstances beyond the control of BloxBay.gg, the Site’s liability shall not be engaged.

6. DISCLAIMER OF WARRANTY

6.1. The Site does not provide any warranty as to the accuracy, reliability, or availability of the information and services offered.

6.2. The Site is provided without any express or implied warranties, including, without limitation, warranties of merchantability or fitness for a particular purpose.

7. AMICABLE DISPUTE RESOLUTION

7.1. In the event of any disagreement or dispute relating to the use of the Site, the User agrees to contact customer service at smtpbloxbay@gmail.com to seek, in good faith, an amicable resolution.

7.2. Only if this procedure fails may the matter be brought before a competent jurisdiction.

8. SECURITY AND USER ACCOUNT

8.1. The User is responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their account.

8.2. The Site disclaims any liability for unauthorized access to an account resulting from the User’s failure to secure their login information.

8.3. In case of any suspicion of hacking or account compromise, the User must immediately inform support via smtpbloxbay@gmail.com.

9. PERSONAL DATA AND PRIVACY

9.1. The collection and processing of Users’ personal data are governed by our Privacy Policy, available at [Link to the Privacy Policy].

9.2. By using the Site, the User consents to the processing of their data in accordance with this Privacy Policy.

10. MODIFICATION OF THE TOS

10.1. BloxBay.gg reserves the right to modify these TOS at any time and without prior notice.

10.2. Modifications shall take effect upon their publication on the Site. Users are advised to review this page regularly to stay informed of any changes.

11. FORCE MAJEURE

11.1. The Site shall not be held responsible for any delay or failure to perform its obligations resulting from a force majeure event, as defined by French jurisprudence.

12. ADDITIONAL DISCLAIMER

12.1. The parties acknowledge that, despite the precautions taken, the Site might unintentionally facilitate exchanges that infringe upon third-party rights.

12.2. In no event shall BloxBay.gg be held liable for legal actions initiated by third parties for violations of their rights, should Users fail to comply with these TOS.

13. GOVERNING LAW AND JURISDICTION

13.1. These TOS are governed by French law.

13.2. In the event of any dispute concerning the interpretation or execution of these TOS, the competent courts shall be those within the jurisdiction of BloxBay.gg’s registered office, subject to an obligatory mediation procedure in disputes between consumers.

15. NON-AFFILIATION CLAUSE

15.1. Bloxbay.gg is an independent platform and is not affiliated, associated, authorized, endorsed, or sponsored by Roblox Corporation, Nikilis, or Murder Mystery 2 (MM2) in any way.

15.2 All trademarks, in-game items, and assets mentioned on this site are the property of their respective owners. Bloxbay.gg does not claim ownership of any intellectual property related to Roblox or MM2.

15.3 Bloxbay.gg does not sell official Roblox or MM2 items—users are only purchasing digital artwork representations. Any reference to MM2 items is for identification purposes only. All exchanges involving MM2 items happen voluntarily between users and are not managed, controlled or guaranteed by Bloxbay.gg.

15.4 Roblox Corporation, Nikilis or Murder Mystery 2 (MM2) are not responsible for any transactions, disputes, or issues arising from the use of this site.

16. AGE RESTRICTIONS

16.1. Access to and use of the Site is reserved for Users who are 18 years of age or older.

16.2. Minors may use the Site only with the consent and under the responsibility of a legal representative. By using the Site, you represent that you meet these conditions.

17. PAYMENT AND REFUND POLICY

17.1. Payments made on the Site are final.

17.2. No refund requests will be accepted, in order to combat money laundering and to prevent the fraudulent use of payment methods. You agree that all transactions are irreversible.

18. USE OF COOKIES AND TRACKING

18.1. The Site may use cookies and other tracking technologies to enhance the user experience and analyze the use of the Site.

19. MODIFICATION AND TERMINATION OF SERVICE

19.1. The Site reserves the right to modify, suspend, or permanently discontinue, in whole or in part, the service at any time without notice.
